Uncle Phil provides various sports-related information services to its users. You agree that you bear the full responsibility for your own decisions as a result of utilizing our information. Uncle Phil, its directors, its employees, and its agents will not be liable for any decision made or action taken by you and others based on news, information, opinions, or any other content published through our Services.
You hereby understand, acknowledge and agree that sports wagering is an inherently risky activity. Any picks, suggestions or probabilities of outcome expressed, published or otherwise disseminated by Uncle Phil its owners, agents or employees are speculative. Any wagering decisions you choose to make should be based on your own understanding of events.
Your communication or business dealings with, or participation in promotions of, advertisers and vendors found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the advertisers and vendors. You agree that Uncle Phil shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers or vendors on the Site, or in connection with our Services. Uncle Phil will not be a party to or in any way monitor any transaction between you and any advertisers or vendors. Uncle Phil reserves the right to refuse to accept a user applying to become a member of the Service. You agree that Uncle Phil, in its sole discretion, may terminate or suspend your account without prior notice or liability, for any reason without limitation, including if we believe you have violated or acted inconsistently with the spirit of our Terms of Service. We may also at our sole discretion and at any time, discontinue providing the Site or Services, or any part thereof, with or without notice. You agree that Uncle Phil may immediately deactivate or delete your user name and password and all related information corresponding to your password and that we can ban further access to the Site when appropriate.
If your account becomes inactive for a period of 12 months, Uncle Phil may, at its option, terminate access to your account, including deletion of any account information.
If you wish to terminate your Uncle Phil account, you may do so by sending an email message to support@unclephilslocks.com with the words “Terminate account” in the subject field. All provisions of these Terms of Use shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
The Terms of Service shall be governed by and construed in accordance with the laws of the State of Arkansas, as if this agreement was made within Arkansas between two residents thereof, and the parties submit to the exclusive jurisdiction of the state and federal courts located in Pulaski County, Arkansas. In any action or proceeding to enforce rights under these Terms of Service, the prevailing party will be entitled to recover costs and attorney’s fees.
As a condition of use, you agree that you shall not use the Service for any purpose that is unlawful or prohibited by these Terms of Service, or any other purpose intended by Uncle Phil. You agree not to use the Service to contribute any content that is infringing, defamatory, obscene, abusive, offensive, or otherwise violates any law or right of any third party or for any illegal or unauthorized purpose. You will not use the information at Uncle Phil to violate any laws within your jurisdiction.
Your Uncle Phil account is intended for your use only and shall not be shared with other persons for any reason without prior approval from us. Excessive log-ins with the same user name and password from different IP addresses can result in a cancellation of your account without refund.
You agree not to utilize web crawlers or any other type of internet bot to browse, index, scrape or obtain content or information in any way from our Site unless expressly authorized by Uncle Phil. Accounts found to be utilizing any of these techniques can be terminated by Uncle Phil without refund.
You agree to indemnify and hold Uncle Phil, and its subsidiaries, directors, officers, other officials, agents, co-branders or other partners, employees, affiliates and other related entities, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out your use of the Service, your connection to the Service, your violation of the Terms of Service, or your violation of any rights of another.
Uncle Phil may provide, or third parties may provide, links to other websites or resources. Because Uncle Phil has no control over such sites and resources, you acknowledge and agree that Uncle Phil is not responsible for the availability of such external sites or resources and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Uncle Phil shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource. You understand that these Terms of Service and our Privacy Policy do not apply to your use of such sites. Uncle Phil provides sports-related information services through various subscription plans. Once you purchase a subscription, you gain immediate access to various content and/or services over a specified length of time. Due to the nature of our Services, we do not offer refunds to customers after purchase. All subscription sales are final. If you cancel before the end of your subscription term, you will continue to have access to your account and the associated content and/or services for the remainder of such subscription term. Uncle Phil reserves the right to issue refunds at our sole discretion but we are not obligated to issue the same or similar refunds in the future.
In certain cases, we may provide an auto-bill option for customers who wish to renew their subscription(s) on a recurring basis. Auto-bill subscriptions will automatically renew immediately upon expiration for the same subscription term as the original purchase. You may cancel auto-bill subscriptions at any time by contacting us via email at support@unclephilslocks.com and you won’t be further charged. You are responsible for whatever charges have already been incurred for the current billing period.
Payments will be handled by Stripe, a third-party service provider, and will be subject to the terms and conditions of Stripe. You hereby consent to using the payment processing services provided by Stripe.
In order to register for our Service, you may be required to provide certain personal information about yourself, including but not limited to, your name, age, birth date, address, phone number and email address. You may also be required to elect certain preferences for content on our website. In consideration of your use of our Services, you agree to provide true, accurate, current and complete information about yourself as requested in connection with the registration process. If any information provided is discovered to be inaccurate, not current or incomplete, Uncle Phil has the right to suspend or terminate your account and/or password and ban future use of our Services.
